1. Acceptance of Terms
By accessing or using Genograms.net ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Genograms.net is a web-based clinical genogram builder platform that enables healthcare providers and their clients to create, collaborate on, and store multi-generational family diagrams. The Service may contain Protected Health Information (PHI) as defined by HIPAA.
3. Eligibility
The Service is intended for use by:
- Licensed healthcare professionals (providers)
- Individuals working with a healthcare provider (clients)
- Individuals 18 years of age or older
By using the Service, you represent that you meet these eligibility requirements.
4. Account Responsibilities
4.1 Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the accuracy of your account information.
4.2 Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
- Using the Service on secured devices and networks
- Logging out when leaving your workstation unattended
4.3 Password Requirements
Passwords must meet the following minimum requirements:
- At least 12 characters in length
- Contains at least one uppercase letter
- Contains at least one lowercase letter
- Contains at least one number
- Contains at least one special character
5. Acceptable Use
5.1 You May:
- Create and manage genograms for legitimate clinical or personal use
- Collaborate with authorized providers and clients
- Export your data in supported formats
- Share genograms with other registered users as appropriate
5.2 You May Not:
- Share your login credentials with any other person
- Use the Service to store information you are not authorized to possess
- Attempt to access other users' data without authorization
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated tools to scrape or extract data from the Service
- Introduce malware, viruses, or any harmful code
- Use the Service for any unlawful purpose
- Attempt to circumvent security controls
6. Protected Health Information (PHI)
6.1 Provider Responsibilities
If you are a healthcare provider using the Service:
- You are responsible for obtaining appropriate patient consent before entering PHI
- You must execute a Business Associate Agreement (BAA) with us before entering PHI
- You are responsible for complying with HIPAA and applicable state privacy laws
- You must ensure your use of the Service is consistent with your organization's privacy policies
6.2 Platform Obligations
We commit to:
- Encrypting all PHI at rest and in transit
- Implementing access controls as described in our Access Control Policy
- Maintaining audit logs as required by HIPAA
- Notifying you of any breach involving your PHI per our Incident Response Plan
- Processing PHI only as described in our Privacy Policy and any applicable BAA
7. Data Ownership
- Your data is yours. You retain all rights to the data you enter into the Service.
- You grant us a limited license to process, store, and transmit your data solely for the purpose of providing the Service.
- You may export or delete your data at any time.
- Upon account deletion, all your data will be securely deleted per our Data Retention Policy (except audit logs retained per HIPAA requirements).
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may:
- Perform maintenance that temporarily disrupts access
- Modify or update the Service with or without notice
- Suspend accounts that violate these Terms
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
Nothing in these Terms limits liability for:
- Willful misconduct
- Breaches of PHI security obligations under applicable BAAs
- Obligations that cannot be excluded by law
10. Indemnification
You agree to indemnify and hold harmless the Service operators from any claims arising from:
- Your violation of these Terms
- Your violation of any third party's rights
- Your misuse of PHI entered into the Service
- Your failure to comply with HIPAA or applicable privacy laws
11. Termination
- You may terminate your account at any time via the Service or by contacting us
- We may terminate or suspend your account for violation of these Terms
- Upon termination, data disposal follows our Data Retention Policy
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated to registered users via email. Continued use of the Service after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the United States and the applicable state jurisdiction. HIPAA requirements apply regardless of jurisdiction for all PHI processed by the Service.
